By accessing or using the Pool and Spa Cloud mobile application and services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Pool and Spa Cloud is a multi-tenant platform that provides:

Customer portal for managing projects and account information
Payment processing and transaction history
Water chemistry test result tracking and synchronization with LabCOM Cloud
Push notifications for important updates
Document and photo storage

3. User Accounts

To use the Service, you must:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

4. Payment Terms

Payment processing is handled securely through Stripe. By submitting a payment:

You authorize us to charge the payment method you provide
All payments are processed in accordance with Stripe's terms of service
Payment status is updated via webhook notifications from Stripe
Refunds are subject to our refund policy and Stripe's processing

5. User Responsibilities

You agree to:

Use the Service only for lawful purposes
Not upload malicious code, viruses, or harmful content
Respect intellectual property rights
Not attempt to gain unauthorized access to the Service
Not interfere with or disrupt the Service
Comply with all applicable laws and regulations

6. Service Limitations

We reserve the right to:

Modify, suspend, or discontinue the Service at any time
Limit access to certain features or functionality
Impose rate limits on API usage
Remove content that violates these Terms

7. Third-Party Services

The Service integrates with third-party services including Stripe (payments), LabCOM Cloud (water test data), and Expo Push Notification Service. Your use of these services is subject to their respective terms and privacy policies.

8. Intellectual Property

The Service, including its design, features, and content, is owned by Pool and Spa Cloud and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Account Termination

We may terminate or suspend your account immediately, without prior notice, if you:

Violate these Terms
Engage in fraudulent or illegal activity
Fail to pay required fees
Request account deletion

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOL AND SPA CLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
